OFFICIAL RULES SONY BMG MUSIC ENTERTAINMENT's ("SONY BMG ") DualDisc Sweepstakes 1. Program Description. No purchase necessary to enter or win. SONY BMG's DualDisc Survey Sweepstakes ("Sweepstakes") begins at 6:00 PM (Eastern Time) July 26, 2005 and ends at 5:59 PM (Eastern Time) on August 19, 2005 (the "Sweepstakes Period"). 2. Eligibility: Only legal U.S. residents at least 18 years of age who reside and who are physically located in the U.S. (excluding residents of the territories and possessions of the United States) are eligible to enter the Sweepstakes. Employees of Sony Corporation of America, Sony Electronics Inc., Sony Music Entertainment Inc., SONY BMG MUSIC ENTERTAINMENT, Bertelsmann AG, Bertelsmann Inc., and those involved in the development, production (including prize suppliers), implementation and distribution of this Sweepstakes and their advertising or promotion agencies, parent companies, service providers, agents, officers, subsidiaries or affiliates, or any other persons or entities directly associated with this Sweepstakes (hereinafter "Sweepstakes Entities") and members of the immediate families and/or persons living in the same household as such persons, are ineligible to enter the Sweepstakes. 3. How to Enter: Access the SONY BMG DualDisc Survey Sweepstakes at the list of websites in Paragraph 11 below. . Complete the survey and registration, and click the "Submit" button. Information requested on the registration form consists of name, postal address, email address, and email format. If there is a dispute about the owner of any email address, it will be deemed submitted by the email account holder. Entrants must complete all required information requested to be eligible. Sponsor assumes no responsibility for lost or late entries, or for any computer, online, telephone, or human error or technical malfunctions that may occur. 4. Winner Selection: The Winner will be selected in a random drawing at the end of the Sweepstakes Period among all eligible online entries received by 5:59 p.m. (Eastern Time) on that day. Odds of winning the Sweepstakes depend on the number of eligible entries received during the Sweepstakes Period. Limit one (1) prize per person during the Sweepstakes Period. 5. PRIZES: The winner will receive a Sony DVD home theater system in a box (HT5800) and 6 SONY BMG DualDiscs (specific DualDisc titles will be choosen by sponsor). At all times, SONY BMG shall have the right to substitute a prize of equal or greater value. (Model numbers listed on the list of prizes are used for descriptive purposes only, and winners are may not actually receive the exact model listed on the prize listing.) No substitution, transfer, or cash equivalent of prizes by any winner. The Winner will receive the prize within 90 days of notification that he/she has won the DualDisc Survey Sweepstakes. 6. Notification: The Winner will be notified by mail, email and/or phone. If a potential winner cannot be reached at the email address or phone number provided on the entry form and/or does not respond to the Sponsor within five (5) days from Sponsor's first attempt to contact him/her, or if he/she is found to be ineligible, or if he/she cannot or does not otherwise comply with these Official Rules, an alternate winner will be selected by random drawing. All entries become Sponsor's property and will not be returned. 7. General Conditions: All Federal, state and local laws and regulations are applicable. All taxes (including, but not limited to, income taxes) are the sole responsibility of winners. Prize winners may be required to execute (and have notarized) an Affidavit of Eligibility, a Liability Release, and a Publicity Release ("Affidavit/Release") which must be returned to and received by Sponsor within ten (10) days from winner's receipt of Affidavit/Release. Prize winners will also be required to send a copy of their passport, driver's license or birth certificate as proof of age. Non-compliance may result in disqualification and an alternate winner may be chosen. Return of prize, prize notification, Affidavit/Release as undeliverable will result in disqualification and an alternate winner may be selected. Entry and/or acceptance of prize(s) constitutes permission for the Sponsor and its affiliates to use the winner's name, address (city and state) and/or likeness for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including without limitation on-line, unless prohibited by law. All entrants agree to comply with these Official Rules. Any person attempting to defraud or in any way tamper with this Sweepstakes and any person who does not comply with these Official Rules, will be ineligible for prizes and may be prosecuted to the full extent of the law. THE NEW YORK COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF NEW YORK SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS. If, for reasons beyond the Sponsor's control, the Sweepstakes is not capable of running as originally planned, such as tampering or infection by computer virus, Sponsor at its sole discretion, reserves the right to cancel or modify the Sweepstakes, without liability. Void where prohibited, restricted or taxed by law. 8. Disclaimers: Entrants agree that Sweepstakes Entities shall not be liable for losses or injuries of any kind resulting from acceptance/possession and/or use/misuse of prize(s), participation in Sweepstakes, or any technical malfunctions of the telephone network and/or transmission line, computer on-line system, computer dating mechanism, computer equipment, hardware, software, or any combination thereof, or any entries that are late (including delayed data transmissions), tampered with, garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, mechanically duplicated, illegible or otherwise not in compliance with these Official Rules. Entrants also agree that the Sweepstakes Entities are not responsible or liable for any injury or damage to an entrant's or third person's computer related to or resulting from Sweepstakes and its prizes. The Sweepstakes Entities are not liable for damage to a user's computer system in any way due to an entrant's participation in the Sweepstakes or downloading any information in connection with the Sweepstakes, including without limitation any server failure, lost, delayed or corrupted data or other malfunction. The Sponsor reserves the right to modify or cancel the Sweepstakes in the event that it becomes technically corrupted. 9.
